Land Expropriation
Where land or an interest in land is needed for Regional purposes, including to build infrastructure such as public utilities, transportation corridors and public facilities, York Region may negotiate with the property owners to reach an agreement to acquire the land or interest in land.
In the event an agreement cannot be reached, the Expropriations Act allows the Region to acquire lands or interests in lands without an owner’s consent, with the Region paying the owner fair compensation for the lands or interests in lands expropriated in accordance with the Act.
The Act defines the term “owner” to include a mortgagee, tenant, execution creditor, a person entitled to a limited estate or interest in land, a guardian of property, and a guardian, executor, administrator or trustee in whom land is vested.
The Act defines the term “land” to include any estate, term, easement, right, or interest in, to, over, or affecting land.
