WHEREAS section 32(1) of the Regional Municipalities Act provides the Regional Corporation with all the powers conferred upon the council or corporation of a city by the Municipal Act, in respect of highways;
AND WHEREAS the Municipal Act allows by-laws to be passed for prohibiting persons from soliciting business on a highway;
THEREFORE, the Council of the Regional Municipality of York HEREBY ENACTS as follows:
1. In this bylaw:
(a) "area municipality" means the municipality or corporation of the Town of Aurora, the Town of Markham, the Town of Newmarket, the Town of Richmond Hill, the City of Vaughan, the Town of Whitchurch-Stouffville, the Town of East Gwillimbury, the Town of Georgina, and the Township of King, as constituted by the Regional Municipality of York Act;
(b) “regional road” means a road forming part of the regional road system established pursuant to section 23 of the Regional Municipalities Act, R.S.O. 1990, chapter R.8.
2. No person shall solicit their commercial tow truck service within 200 metres of the scene of any accident or within 200 metres of any vehicle involved in an accident on a regional road.
3. Every person contravening the provisions of section 2 of this bylaw is guilty of an offence and on conviction is liable to a fine of $250.00 exclusive of costs for the first offence, and $1,000.00 exclusive of costs for each subsequent offence.
4. The provisions of this bylaw may be enforced:
(a) by a police officer;
(b) by a bylaw enforcement officer duly appointed by the Council of an area municipality; and
(c) by any person appointed for the purpose by bylaw of the Council of the Regional Municipality of York.
