Regional Council met at 9:04 a.m. in the Council Chambers, York Region Administrative Centre, 17250 Yonge Street, Newmarket, with Regional Chair Emmerson presiding.

Opening Remarks from Regional Chairman
142 Regional Chair Emmerson made the following remarks:
I would like to begin today’s meeting by acknowledging that York Region extends over lands originally used and occupied by Indigenous Peoples, and on behalf of York Region, I would like to thank First Nations and the Métis for sharing this land.
I would also like to acknowledge the Chippewas of Georgina Island First Nation as our closest First Nation community.

143 Minutes of the Council Meeting Held on September 21, 2017
It was moved by Regional Councillor Ferri, seconded by Mayor Van Bynen that Council confirm the Minutes of the Council Meeting held on September 21, 2017 in the form supplied to the Members.

144 Report No. 13 of Committee of the Whole – October 5, 2017
It was moved by Mayor Dawe, seconded by Regional Councillor Ferri that Council adopt the recommendations in Report No. 13 of Committee of the Whole with the following amendment as noted:
Proposed Rerouting of the Greater Toronto Rail Network
4.1 Receipt of the communication from Paul Jankowski, Commissioner of Transportation Services dated September 22, 2017 regarding “Proposed Rerouting of Greater Toronto Rail Network.”
The Regional Clerk circulate the communication to the Prime Minister, Premier, Federal Minister of Transport, Federal Minister of Infrastructure and Communities, Provincial Minister of Transportation, Provincial Minister of Infrastructure, York Region Members of Federal and Provincial Parliament, and that the Regional Chair, Mayors of Markham, Richmond Hill and Vaughan write to those individuals to express their Councils’ opposition and concerns regarding the rerouting of freight trains and hazardous materials through York Region.

It was moved by Mayor Van Bynen, seconded by Mayor Dawe that Council adopt the recommendations in Report No. 14 of Committee of the Whole.

146 Report No. 2 of Debenture Committee – September 27, 2017
It was moved by Mayor Hackson, seconded by Mayor Quirk that Council receive Report No. 2 of Debenture Committee.

147 Report No. 1 of the Commissioner of Community and Health Services and Medical Officer of Health [2.7 MB]
It was moved by Councillor Taylor, seconded by Councillor Hogg that Council:
1. Receive the presentation by Katherine Chislett, Commissioner of Community & Health Services and Dr. Karim Kurji, Medical Officer of Health regarding Public Health within an Integrated Health System: Response to the Recommendation of the Minister’s Expert Panel on Public Health.
2. Adopt the following recommendations in Report No. 1 of the Commissioner of Community and Health Services and Medical Officer of Health, as amended, regarding the Public Health within an Integrated Health System: Response to the Recommendations of the Minister’s Expert Panel on Public Health:
1. York Region Council and the York Region Board of Health do not support the Expert Panel on Public Health recommendations including the separation of Public Health from the York Region structure.
2. Council and the Board of Health approve Attachment 1 as its response to the recommendations made by the Minister of Health and Long-Term Care’s Expert Panel on Public Health, and direct staff to submit the response to the Ministry of Health and Long-Term Care by the consultation deadline of October 31, 2017.
3. This report be circulated by the Regional Clerk to all nine local municipalities, York Region Members of Provincial Parliament, Canadian Union of Public Employees Local 905 (York Region Unit), Ontario Nurses Association Local 16, the Association of Municipalities of Ontario, the Association of Local Public Health Agencies, the other 35 Boards of Health and the other 46 of the Province’s Consolidated Municipal Service System Managers/District Social Services Administration Boards.
4. The Regional Chair be requested to arrange a meeting with the Minister of Health and Long-Term Care to outline the Region’s concerns regarding the Expert Panel on Public Health’s recommendations.
5. The Minister of Health and Long-Term Care be requested to hold a province-wide public consultation if they decide to proceed with the Expert Panel on Public Health’s proposed recommendations.

Bylaw No. 2017-53
A bylaw to authorize a Municipal Capital Facilities Agreement between The Regional Municipality of York and YTN Telecom Network Inc.

149 Diwali – October 19, 2017
Regional Councillor Singh recognized that October 19, 2017 is Diwali and encouraged Council members to send out greetings of Diwali to their constituents.
150 York Region Matters
Regional Chair Emmerson advised that the fall edition of York Region Matters will be distributed to more than 380,000 households in York Region beginning next week.
151 Waste Reduction Week
Regional Chair Emmerson recognized the week of October 16 to 20, 2017 as Waste Reduction Week across Canada.
152 Amazon Bid
Regional Chair Emmerson advised that Toronto Global submitted their bid for Amazon’s second headquarters, which included potential locations within York Region. He also thanked local municipal partners and their staff for their contributions.
Consideration and Adoption of Private Items

It was moved by Mayor Bevilacqua, seconded by Regional Councillor Ferri that Council convene in Private Session for the purpose of considering the following.
1. Waste Processing Facility Update - Solicitor-Client Privilege and Potential Litigation
2. Development Charge Complaint Presentation and Report - Development Charge Rates for 6053971 Canada Inc., City of Vaughan – Solicitor-Client Privilege

It was moved by Regional Councillor Ferri, seconded by Mayor Hackson that Council adopt the following recommendation in the confidential report from the Commissioner of Environmental Services dated September 26, 2017:
1. It is recommended that this report be received for information.

155 Development Charge Complaint- Development Charge Rates for 6053971 Canada Inc., City of Vaughan
It was moved by Mayor Bevilacqua, seconded by Mayor Barrow that Council:
1. Receive the private presentation by Bola Ogunmefun, Associate Counsel, Legal Services regarding Development Charge Complaint-Development Charge Rates for 6053971 Canada Inc., City of Vaughan.
2. Adopt the following recommendations in the private report from the Commissioner of Finance dated September 6, 2017:
1. Council dismiss the Development Charge Complaint lodged by 6053971 Canada Inc.
2. Council authorize staff to defend the dismissal of the Development Charge Complaint at the Ontario Municipal Board should 6053971 Canada Inc. appeal Council’s decision.
3. Council authorize the Commissioner of Finance to settle the Development Charge Complaint and execute Minutes of Settlement, if appropriate.

It was moved by Mayor Van Bynen, seconded by Regional Councillor Hogg that Council enact Bylaw No. 2017-54 to confirm the proceedings of this meeting of Council held on October 19, 2017.
