Regional Council met at 9:02 a.m. in the Council Chambers, York Region Administrative Centre, 17250 Yonge Street, Newmarket, with Regional Chair Emmerson presiding.

Opening Remarks from Regional Chairman
122 Regional Chair Emmerson made the following remarks:
“I would like to begin today’s meeting by acknowledging that York Region extends over lands originally used and occupied by Indigenous Peoples, and on behalf of York Region, I would like to thank First Nations and the Métis for sharing this land.
I would also like to acknowledge the Chippewas of Georgina Island First Nation as our closest First Nation community.”

Clause 36 of Committee of the Whole Report No. 12 and Minute No. 137
Regional Councillor Armstrong declared an interest in Clause 36 of Committee of the Whole Report No. 12 and Council Minute No.137, as follows: “My son has purchased a unit on the said property owned by CIM”. Regional Councillor Armstrong left the room during the private session discussion and did not participate in, or influence, the public session vote on this item.

It was moved by Mayor Bevilacqua, seconded by Regional Councillor Ferri that Council receive the communication from Paul Jankowski, Commissioner of Transportation Services dated September 13, 2018 and refer it to consideration of Clause 6 of Committee of the Whole Report No. 12.

It was moved by Mayor Pellegrini, seconded by Mayor Van Bynen that Council receive the communication from Susan Rosenthal, Davies Howe LLP on behalf of Yonge Green Lane GP Inc. dated September 18, 2018 refer it to consideration of Clause 16 of Committee of the Whole Report No. 12.

128 Report No. 12 of the Committee of the Whole - September 6, 2018
It was moved by Regional Councillor Singh, seconded by Regional Councillor Davison that Council adopt the recommendations in Report No. 12 of Committee of the Whole with the following amendment as noted:
York Region and York Regional Police Joint Services Agreement Amendment (Clause 6)
Amend the report of the Commissioner of Transportation Services dated August 10, 2018 to include additional powers be granted to York Region Transit Special Constables to enforce limited provisions under the Cannabis Act, 2017.
Amend recommendation #1 as follows:
1. Council request that York Regional Police Services Board grant York Region Transit Special Constables additional powers to permit them to enforce certain provisions of the Cannabis Act, Mental Health Act, Liquor Licence Act and Trespass to Property Act.

129 Report No. 1 of the Commissioner of Corporate Services and Regional Clerk - Updating the Procedure Bylaw to Accommodate the Appointment of the Regional Chair
It was moved by Regional Councillor Davison, seconded by Mayor Dawe that Council waive the notice requirements to allow for the reconsideration of Bylaw No. 2018-40 which was considered at the May 17, 2018 Regional Council meeting.

It was moved by Mayor Pellegrini, seconded by Mayor Van Bynen that Council reconsider Bylaw No. 2018-40, which was considered at the May 17, 2018 Regional Council meeting.

It was moved by Mayor Hackson, seconded by Regional Councillor Ferri that Council adopt the following recommendation in the report dated September 11, 2018 from the Commissioner of Corporate Services and Regional Clerk:
1. The Region’s Procedure Bylaw 2018-40 be amended to incorporate the changes set out in Attachment 1 to accommodate the appointment of the Regional Chair.

130 Report No. 1 of the Commissioner of Transportation Services - York Region Transit Cross-Boundary Travel and Greater Toronto Hamilton Fare Integration
It was moved by Regional Councillor Rosati, seconded by Regional Councillor Ferri, to amend the recommendation contained in the report dated September 18, 2018 from the Commissioner of Transportation Services to include the following clause:
4. Staff request the TTC to consider an exception to the 2009 memorandum of Understanding signed by York Region, City of Toronto and TTC allowing service to continue to York University until fare integration is implemented.

It was moved by Regional Councillor Heath, seconded by Regional Councillor Rosati that Council adopt the following recommendations, as amended, in the report dated September 18, 2018 from the Commissioner of Transportation Services:
1. Council pass a resolution seeking commitment from the Board of Directors of Metrolinx to finalize a Greater Toronto and Hamilton Area wide fare integration solution by 2019, to allow for full implementation as part of the PRESTO device refresh, scheduled for 2020 or sooner.
2. The Regional Chair forward the resolution to The Honourable John Yakabuski, Minister of Transportation, with a copy to Local Members of Provincial Parliament and the Chair of Metrolinx, highlighting the urgency and the importance to have this issue addressed.
3. This Council resolution and report be circulated to the Clerks of the Regional Municipality of Durham, City of Toronto, City of Brampton, City of Mississauga, City of Milton, City of Oakville, City of Burlington, and the City of Hamilton.
4. Staff request the TTC to consider an exception to the 2009 Memorandum of Understanding signed by York Region, City of Toronto and TTC allowing service to continue to York University until fare integration is implemented.
