Regional Council met at 9 a.m. in the Council Chambers, York Region Administrative Centre, 17250 Yonge Street, Newmarket, with Regional Chair Emmerson presiding.

Opening Remarks from Regional Chairman
120 Regional Chair Emmerson made the following remarks:
“I would like to begin today’s meeting by acknowledging that York Region extends over lands originally used and occupied by Indigenous Peoples, and on behalf of York Region, I would like to thank First Nations and the Métis for sharing this land.
I would also like to acknowledge the Chippewas of Georgina Island First Nation as our closest First Nation community.”

It was moved by Mayor Quirk, seconded by Regional Councillor Taylor that Council confirm the Minutes of the Council meeting held on June 29, 2017 in the form supplied to the Members.

It was moved by Mayor Barrow, seconded by Mayor Bevilacqua that Council receive the Toronto Pearson: Canada’s Gateway presentation from Michelle Samson-Doel, Board Member representing York Region and Lorrie McKee, Director of Public Affairs and Stakeholder Relations, Greater Toronto Airports Authority.

123 Municipal Court Managers Association of Ontario Award
On behalf of Regional Council, Chairman Emmerson acknowledged Lisa Brooks, Director, Court Operations, Legal and Court Services as the recipient of the 2017 Award for Innovation from the Municipal Court Managers Association of Ontario. The award recognizes the ability to be an advocate for change, be creative and forward thinking, promote new ideas and introduce unique solutions and to take calculated risks to improve the organization.

It was moved by Regional Councillor Hogg, seconded by Regional Councillor Rosati that Council receive the communication from Karen Addison, Executive Director, Character Community Foundation of York Region, dated July 13, 2017, and recognize October 23 to 28, 2017 as ‘Character Community Week’.

128 Traffic Control Signal - Intersection of Mount Albert Road and Centre Street, Town of East Gwillimbury
Regional Council was in receipt of a communication from Fernando Lamanna, Municipal Clerk, Town of East Gwillimbury dated September 20, 2017.
It was moved by Mayor Hackson, seconded by Mayor Quirk that Council reconsider its May 25, 2017 decision to install traffic control signals at the intersection of Mount Albert Road and Centre Street.
Carried by the required two-thirds majority
It was moved by Mayor Hackson, seconded by Mayor Quirk that Council adopt the following motion contained in the communication from the Town of East Gwillimbury:
Whereas the Regional Municipality of York has proposed to install a traffic control signal at the intersection of Mount Albert Road and Centre Street in the Town of East Gwillimbury; and
Whereas residents of Mount Albert have expressed concern that the proposed traffic control signal will create a traffic safety hazard and will result in traffic congestion;
Be it resolved that the Council of the Town of East Gwillimbury request that the Council of the Regional Municipality of York defer its decision on the traffic control signal at the intersection of Mount Albert Road and Centre Street to permit the Region to consider alternatives and options to the proposed signalized intersection and to provide for further public engagement; and
That Council request that the Region provide all relevant studies and reports to the residents that have requested them.

Motions
131 Housing York Inc. Board – Membership Increase
It was moved by Regional Councillor Heath, seconded by Regional Councillor Rosati that Council adopt the following motion:
Whereas the Articles of Arrangement of Housing York Inc. (the “Corporation”) provide that the Corporation shall have a minimum of two (2) directors and a maximum of thirteen (13) directors; and,
Whereas by special resolution dated January 22, 2015 the sole shareholder of the Corporation fixed the number of directors of the Corporation at ten (10);
Be it Resolved that:
1. By special resolution the number of directors comprising the Board of Directors of the Corporation is fixed at eleven (11).
2. Councillor Singh be appointed to the Housing York Inc. Board of Directors.

Notice of Motion
Mayor Barrow assumed the Chair and Regional Chair Emmerson presented the following Notice of Motion, to be included as a Motion on the October 19, 2017 Regional Council agenda:
Whereas Bill 70, Building Ontario Up for Everyone Act (Budget Measures), 2016, amended Section 218 of the Municipal Act to prescribe that “for a regional municipality other than the County of Oxford, the head of council shall be elected by general vote in accordance with the Municipal Elections Act, 1996;” and,
Whereas in the absence of a legislated definition for ‘general vote’, this amendment could be interpreted to mean a general vote of a lower-tier municipality, rather than an election at large across the entire regional municipality; and,
Whereas 21 upper-tier municipalities, such as the County of Simcoe, are exempted from the provisions of Bill 70 and are permitted to select their heads of council from among their own membership who are elected by a general vote of a lower-tier municipality;
Therefore be it resolved that the Province be requested to enact a regulation to:
1. exempt York Region from the requirements set out in Section 218 of the Municipal Act with respect to electing the head of the upper-tier municipality by general vote conducted across all nine local municipalities; and,
2. confirm that York Region Council will duly appoint one of its directly elected members as the Regional Chair, who will maintain his/her position on the council of the local municipality; and,
3. reduce the composition of Regional Council from 21 to 20 members without being subject to the notice, triple majority and timing requirements set out in Section 219 of the Municipal Act; and further,
4. make the requested changes in effect for the 2018 Municipal Election.

132 Appointments
Regional Chair Emmerson announced the following appointments:
1. Regional Councillor Davison is appointed to the York Region Agricultural Advisory Liaison Group.
2. Mayor Bevilacqua is appointed to the Police Services Board.
133 Recognition of Mayor Scarpitti – Police Services Board
Regional Chair Emmerson recognized Mayor Scarpitti for his role on the Police Services Board. Mayor Scarpitti sat on the Board for ten years, five years as Chair, and is one of the longest serving Board members.
134 Municipal Accessibility Champion Award
Regional Chair Emmerson acknowledged Lisa Gonsalves, Director, Strategies and Partnerships Branch, Community and Health Services who received the Municipal Accessibility Champion Award from the Ontario Municipal Social Services Association.
135 Provincial Volunteer Service Award
Regional Chair Emmerson acknowledged Steve Foglia, Vice Chair of the York Region Accessibility Advisory Committee, who received the Provincial Volunteer Service Award.
136 2018 Council and Committee Meeting Calendar [as presented to Council]

It was moved by Mayor Hackson, seconded by Regional Councillor Ferri that Council adopt the 2018 Council and Committee Meeting Schedule, as provided on the Revised Agenda.

It was moved by Regional Councillor Hogg, seconded by Mayor Pellegrini that Council convene in Private Session for the purpose of considering the following.

2. Expropriation Settlement – Major Mackenzie Drive from Canadian Pacific Railway Crossing to Islington Avenue, City of Vaughan – Land Acquisition

138 2017 Development Charge Bylaw Appeals
It was moved by Regional Councillor Jones, seconded by Mayor Altmann that Council adopt the recommendations in the private report of the Commissioner of Finance dated August 24, 2017, as follows:
1. Regional Council authorize the actions set out in Table 4 to address the six appeals of the 2017 Regional Development Charge Bylaw.
2. The Regional Solicitor or designate be authorized to execute Minutes of Settlement or other documents required to implement the recommended actions.

139 Expropriation Settlement – Major Mackenzie Drive from Canadian Pacific Railway Crossing to Islington Avenue, City of Vaughan
It was moved by Regional Councillor Jones, seconded by Mayor Altmann that Council adopt the recommendations in the private report of Commissioner of Corporate Services dated August 23, 2017, as follows:
1. Council authorize the settlement of the expropriation of the following land required for the widening and reconstruction of Major Mackenzie Drive, City of Vaughan, on the terms set out in this report.
