Regional Council met at 9 a.m. in the Council Chambers, York Region Administrative Centre, 17250 Yonge Street, Newmarket, with Regional Chair Emmerson presiding.

51 Police Services Act Modernization and Police Services Act Review and Consultation on the Strategy for a Safer Ontario
Mayor Quirk declared an interest in the communication from Matthew Wilson, Senior Advisor, Association of Municipalities of Ontario dated April 13, 2016 regarding “Police Services Act Modernization” and Report No. 1 of the Regional Solicitor regarding “Police Services Act Review and Consultation on the Strategy for a Safer Ontario”.
This declaration of interest is due to Mayor Quirk’s stepson being a member of York Regional Police and her husband being a retired member of and under contract to York Regional Police.
Mayor Quirk did not take part in any consideration or discussion of or vote on any part of these items.

52 Minutes of the Council Meeting held on March 24, 2016
It was moved by Mayor Altmann, seconded by Mayor Pellegrini that Council confirm the Minutes of the Council meeting held on March 24, 2016 in the form supplied to the Members.

Council heard the following presentation:
53 Presentation to Stephen Lam, Director of Immigrant Services, Catholic Community Services of York Region
Regional Chair Emmerson provided an overview the Community Partnership Council (CPC) and its role in developing and implementing the Immigration Settlement Strategy. Regional Chair Emmerson noted of the success of the strategy and introduced a video highlighting the CPC’s many actions to support newcomer integration in York Region.
On behalf of Council, Regional Chair Emmerson welcomed Stephen Lam, Director of Immigrant Services with the Catholic Community Services of York Region, who served as Co-Chair of the CPC since its creation in 2010. Regional Chair Emmerson recognized that the leadership of Mr. Lam and Mayor Scarpitti as Co-Chairs of the CPC has strongly contributed to making York Region one of the most welcoming communities in Canada.
Adelina Urbanski, Commissioner of Community and Health Services, praised Mr. Lam for giving tirelessly to the community while continuously advocating for a strategy to address immigrant issues in York Region.
In recognition of Stephen Lam’s outstanding commitment to promote newcomer integration in York Region, a community park bench will be dedicated in his name.
In gratitude for his contributions, Council presented Steven Lam with the soon-to-be in place community park bench in recognition of his outstanding commitment to promote newcomer integration in York Region.
It was moved by Mayor Barrow, seconded by Mayor Bevilacqua that Council receive the presentation.

54 2016 Federal Budget
It was moved by Mayor Barrow, seconded by Mayor Bevilacqua that Council receive the communication from Bill Hughes, Commissioner of Finance and Regional Treasurer dated April 14, 2016 forwarding an overview of the main elements in the 2016 Federal Budget that are important to York Region and that the Regional Clerk circulate the communication to the local municipalities.

It was moved by Mayor Pellegrini, seconded by Regional Councillor Wheeler that Council receive the communication from Bill Hughes, Commissioner of Finance and Regional Treasurer dated April 14, 2016, forwarding an overview of the main elements in the 2016 Provincial Budget that are important to York Region and that the Regional Clerk circulate the communication to the local municipalities.

57 Proposed Rerouting of the Greater Toronto Rail Network Draft Resolution
It was moved by Regional Councillor Jones, seconded by Regional Councillor Di Biase that Council receive the communication from Daniel Kostopoulos, Commissioner of Transportation Services dated April 20, 2016 regarding “Proposed Rerouting of the Greater Toronto Rail Network Draft Resolution” and adopt the following:
Whereas the Cities of Cambridge, Mississauga and Toronto and the Town of Milton completed the “Feasibility and Business Case of Constructing the Missing Link” to assess the feasibility of separating freight rail and passenger rail traffic on the Milton and Kitchener GO rail corridors by constructing a new rail corridor and other improvements to link the Canadian National Railway bypass line in Bramalea with the Canadian Pacific Railway through line near the Milton-Mississauga border thereby facilitating a rerouting of freight rail traffic from the Cities of Toronto and Mississauga to southern York Region, in the Cities of Markham and Vaughan.
And Whereas Council at its meeting held on January 21, 2016, adopted Clause 3 in Report No. 1 of Committee of the Whole regarding Feasibility Study for Proposed Rerouting of the Greater Toronto Rail Network, including resolving that Council formally request Metrolinx to undertake consultation with York Region, the Cities of Markham and Vaughan and the Town of Richmond Hill before proceeding with additional studies relating to the rerouting of freight rail traffic in York Region.
And Whereas Council of the City of Markham at its meeting on March 1, 2016, adopted a number of resolutions, objecting to the recommendations of the Feasibility and Business Case of Constructing the Missing Link, including that the Prime Minister, the Premier, Federal and Provincial Transportation Ministers, the project proponents and others be advised that the City of Markham strongly objects to rerouting additional freight rail traffic through the City of Markham.
And Whereas Report No. 6 of the Committee of the Whole meeting held on April 7, 2016, recommended that staff prepare a similar resolution to that of the City of Markham dated March 1, 2016, for consideration by Council at its meeting to be held on April 21, 2016.
Now therefore be it resolved:
1. That Metrolinx be advised that rerouting of freight rail traffic through York Region is not supported by the Council of the Regional Municipality of York.
2. That Council reiterate its previous request of January 2016 that Metrolinx undertake consultation with York Region, the Cities of Markham and Vaughan and the Town of Richmond Hill before proceeding with additional studies relating to the rerouting of freight rail traffic in York Region.
3. That the Regional Clerk forward this resolution to the Prime Minister, the Premier, Federal and Provincial Transportation Ministers, Local MPs and MPPs, the Cities of Markham, Vaughan, Cambridge, Mississauga and Toronto, the Towns of Richmond Hill and Milton, Metrolinx, CN Rail and CP Rail.

59 Report No. 7 of the Committee of the Whole – April 14, 2016
It was moved by Mayor Pellegrini, seconded by Regional Councillor Wheeler that Council adopt the recommendations in Report No. 7 of Committee of the Whole with the following amendment:
Jurisdiction of the Ontario Municipal Board (Clause 4)
It was moved by Regional Councillor Armstrong, seconded by Mayor Dawe that Council adopt the following:
1. That Regional Council support the positions of the Town of Aurora, the City of Markham and the Town of Richmond Hill and reaffirm its decision of January 23, 2014 that the Province be requested to undertake a comprehensive review of the role, operations, practices and procedures of the Ontario Municipal Board within the Land Use Planning and Appeal System.
2. That Regional Council’s decision be forwarded by the Regional Clerk to the Premier, the Minister of Municipal Affairs and Housing, the Leaders of the Progressive Conservative and NDP Parties, and all York Region MPPs.

60 Police Services Act Review and Consultation on the Strategy for a Safer Ontario
It was moved by Mayor Dawe, seconded by Mayor Van Bynen that Council adopt the following recommendations in Report No. 1 of the Regional Solicitor dated April 15, 2016:
1. Council respond to the Police Services Act review and consultation on the Strategy for a Safer Ontario in the form set out in the attached letter.
2. The Regional Clerk circulate the letter and this report to the Ministry of Labour, the Association of Municipalities of Ontario, the Ontario Association of Police Services Boards and local municipalities.

61 Agreement with Ontario Ministry of Transportation - Highway 404 Midblock Crossing North of Highway 7 and Highway 404 Northbound Ramp Extension at Highway 7, City of Markham and Town of Richmond Hill
It was moved by Regional Councillor Armstrong, seconded by Regional Councillor Heath that Council adopt the following recommendations in Report No. 1 of the Commissioner of Transportation Services dated April 20, 2016:
1. Council authorize entering into an agreement with the Ontario Ministry of Transportation for the construction and long-term maintenance of the Highway 404 midblock crossing, north of Highway 7 and Highway 404 northbound ramp extension at the Highway 404/ Highway 7 interchange.
2. Council authorize the Commissioner of Transportation Services to execute the agreement on behalf of the Region subject to the approval of Legal Services as to the form and content.

63 Appointment to the Board of Directors of the Federation of Canadian Municipalities
Members of Council thanked Regional Councillors Heath and Hogg for their previous representation of the Region on the Board of Directors of the Federation of Canadian Municipalities (FCM).
It was moved by Regional Councillor Heath, seconded by Mayor Bevilacqua that Council appoint Regional Chair Emmerson as the Region’s representative on the FCM Board of Directors for the 2016-2017 term of FCM.

64 Private Council Education Session - May 26, 2016
It was moved by Mayor Barrow, seconded by Mayor Van Bynen that Regional Council hold a meeting that is closed to the public pursuant to section 239(3.1) of the Municipal Act for the purposes of educating its Members on matters pertaining to Regional Governance.
The meeting will be held on Thursday, May 26, 2016 in the Seminar Room, Regional Administrative Centre, 17250 Yonge Street, Newmarket, Ontario commencing at 9 a.m.

65 Daniel Kostopoulos, Commissioner of Transportation Services
Regional Chair Emmerson congratulated Daniel Kostopoulos, Commissioner of Transportation Services, on his acceptance of a new position as City Manager at the City of Vaughan.
Mayor Bevilacqua indicated that he is looking forward to Mr. Kostopoulos joining the City of Vaughan in June 2016.
