Regional Council met at 9:03 a.m. in the Council Chambers, York Region Administrative Centre, 17250 Yonge Street, Newmarket, with Regional Chair Emmerson presiding.

Opening Remarks from Regional Chairman
1 Regional Chair Emmerson made the following remarks:
“I would like to begin today’s meeting by acknowledging that York Region extends over lands originally used and occupied by Indigenous Peoples, and on behalf of York Region, I would like to thank First Nations and the Métis for sharing this land.
I would also like to acknowledge the Chippewas of Georgina Island First Nation as our closest First Nation community.”

It was moved by Mayor Pellegrini, seconded by Regional Councillor Davison that Council confirm the Minutes of the Council meeting held on December 14, 2017 in the form supplied to the Members.

3 Provincial Update - Establishing Retail and Distribution Channels for Legal Cannabis
It was moved by Regional Councillor Spatafora, seconded by Regional Councillor Armstrong that Council receive the communication from Charles Sousa, Minister of Finance, dated January 2, 2018.

Consideration and Adoption of Reports

5 Report No. 1 of Committee of the Whole - January 18, 2018
It was moved by Mayor Pellegrini, seconded by Mayor Quirk that Council adopt the recommendations in Report No. 1 of Committee of the Whole with the following amendments as noted:
Upper York Sewage Solutions Individual Environmental Assessment Approval Status Update (Clause 8)
It was moved by Mayor Van Bynen, seconded by Regional Councillor Taylor that Council amend recommendation 2 to read as follows:
2. That the Regional Municipality of York and the Ministry of the Environment and Climate Change jointly develop and implement a Specific Emergency Response Plan to prevent risks to public health and the environment in the Towns of Newmarket, Aurora and East Gwillimbury in the event of a sanitary sewage spill into the environment due to any failure of the York Durham Sewage System forcemain in the Town of Newmarket until such time as the forcemain has been twinned and has been commissioned.
3. That any costs incurred due to preparation of the Plan and such an event be recovered from the Province of Ontario.

Communications – Finance and Administration (Clause 15)
It was moved by Mayor Scarpitti, seconded by Mayor Bevilacqua that Council amend recommendation 1 to read as follows:
1. Receipt of the communication from Graham Milne, Regional Clerk, Halton Region, dated December 20, 2017 regarding “MPAC Service Delivery Shortcomings” and endorse the resolution contained therein; and,
2. The Regional Chair will send a letter to MPAC outlining York Region’s concerns with their services.

6 Report No. 1 of the Commissioner of Corporate Services and the Chief Planner
It was moved by Regional Councillor Li, seconded by Mayor Dawe that Council adopt the following recommendations in Report No. 1 of the Commissioner of Corporate Services and the Chief Planner regarding “Proposed Inclusionary Zoning Regulation Content EBR Posting 013-1977”:
1. The Province be advised that York Region has significant concerns with the utility of Inclusionary zoning as a tool to increase the supply of affordable housing if the Regulations are approved as currently described in EBR Posting No. 013-1977. Specifically:
a. The prescriptive nature of the proposed regulations brings the feasibility of inclusionary zoning into question,
b. Municipal resources required to administer the zoning, coupled with mandatory municipal financial offsets, is likely to result in unacceptable impacts to municipal budgets, and
c. Inclusionary zoning as proposed through the draft regulation content will not meet Provincial objectives as municipal uptake will likely be limited.
2. The Province be requested to revisit the draft regulations and revise in consultation with municipalities.
3. The Regional Clerk circulate this report to the Federal Minister of Families, Children and Social Development, the Provincial Ministers of Housing and Municipal Affairs, the Clerks of the Local Municipalities and the Association of Municipalities of Ontario.

A bylaw to amend Bylaw No. A-0263-1999-064 to provide for certain insurance and reimbursement of Members of Council and employees by The Regional Municipality of York

8 Lina Bigioni, Chief of Staff
Regional Chair Emmerson congratulated Lina Bigioni, Chief of Staff, on her milestone anniversary of 20 years at York Region. On behalf of Council, Regional Chair Emmerson thanked Ms. Bigioni for her dedicated service.
9 York Regional Police Services Board
Regional Chair Emmerson congratulated Mayor Hackson on her re-election as Chair of the York Regional Police Services Board.
10 Valerie Shuttleworth, Chief Planner
Regional Chair Emmerson recognized the retirement of Valerie Shuttleworth, Chief Planner. Ms. Shuttleworth joined York Region in 2013 and brought with her over 25 years of planning experience.
Regional Chair Emmerson indicated that Council has relied heavily on Ms. Shuttleworth’s experience and insight to help inform some tough planning decisions.
Regional Chair Emmerson praised Ms. Shuttleworth and her team for many achievements, including: successfully defending the Regional Official Plan through the OMB process; providing fundamental input into the OMB reform and Provincial Plans update; launching the YorkLink business attraction campaign; leveraging the Region’s post-secondary investment attraction strategy; helping advance the York Telecom Network; and, leading the Municipal Comprehensive Review.
On behalf of Council, Regional Chair Emmerson thanked Ms. Shuttleworth for her dedication to making better communities and wished her a long and healthy retirement.
11 Council Education Session – February 15, 2018 – Cannabis Legislation
It was moved by Mayor Dawe, seconded by Regional Councillor Armstrong that Regional Council hold a meeting that is closed to the public under section 239(3.1) of the Municipal Act for the purposes of educating its Members on cannabis legislation.
The meeting will be held on Thursday, February 15, 2018 in the Council Chambers, Regional Administrative Centre, 17250 Yonge Street, Newmarket, Ontario commencing immediately following the regular Council meeting scheduled for that same date.

12 York Telecom Network Board of Directors – February 15, 2018
Regional Chair Emmerson advised Council that the first meeting of the York Telecom Network Board of Directors would take place on February 15, 2018 at 1 p.m. following the Council Education Session.
13 Housing York Inc. Board of Directors – February 1, 2018
Regional Chair Emmerson advised Council that the Housing York Inc. Board of Directors meeting scheduled on February 1, 2018 will start immediately following Committee of the Whole.
14 Amazon Headquarters Bid
Regional Chair Emmerson advised that Toronto Global’s bid for Amazon’s second headquarters includes potential York Region locations.
Consideration and Adoption of Private Items
15 Private Session
It was moved by Regional Councillor Hogg, seconded by Regional Councillor Rosati that Council convene in Private Session for the purpose of considering the following.
1. Appointment of Associate Medical Officer of Health - Personal Matters about an Identifiable Individual
2. Update on Collective Bargaining with the Ontario Nurses Association - Labour Relations

Council met in Private Session at 9:27 a.m. and reconvened in public at 9:49 a.m.
It was moved by Regional Councillor Singh, seconded by Mayor Quirk that Council rise and report from Private Session.

16 Appointment of Associate Medical Officer of Health
It was moved by Regional Councillor Taylor, seconded by Regional Councillor Rosati that Council adopt the confidential recommendations in the private report of the Medical Officer of Health and Commissioner of Community and Health Services dated January 19, 2018 and that the recommendations will become public upon provincial approval of the appointment.

Following provincial approval on April 16, 2018, Regional Council made the following recommendations public:
1. Council appoint Dr. Alanna Fitzgerald-Husek to the position of Associate Medical Officer of Health for The Regional Municipality of York effective March 5, 2018, subject to approval by the Minister of Health and Long-Term Care.
2. Regional staff be authorized to do all things necessary to carry out the above recommendation, including sending a copy of this private report to the Ministry of Health and Long-Term Care.
17 Update on Collective Bargaining with the Ontario Nurses Association
It was moved by Regional Councillor Taylor, seconded by Regional Councillor Rosati that Council receive the confidential memorandum from the Executive Director, Human Resources dated January 25, 2018.

Confirmatory Bylaw
18 Bylaw 2018-04
It was moved by Mayor Altmann, seconded by Regional Councillor Armstrong that Council enact Bylaw No. 2018-04 to confirm the proceedings of this meeting of Council held on January 25, 2018.
